Estate Planning

Probate

When a person passes away, his or her estate must go through probate, which is a process overseen by a probate court. If the decedent leaves a will directing how one’s property should be distributed after his or her passing, the probate court must determine if it should be admitted to probate and given legal effect. If the decedent passes way intestate (without leaving a will) the court appoints a personal representative to distribute the decedent's property according to the laws of descent and distribution. These laws direct the distribution of assets based on hereditary succession.  This can be a difficult time for people as the process of probate often involves complex finances, emotions and familial relationships.  The Law Firm of Cohen & Owens, P.A. is sensitive to the needs of individuals during the administration of probate and will work for and with you during this process.

Commercial and Civil Litigation

Commercial Litigation is generally understood to comprise the provision of advice and representation, whether by way of negotiation, civil proceedings, alternative dispute resolution, mediation or arbitration, in all matters relating to the breach of or disputes regarding commercial contracts; purchase and sale of assets, equipment or other lease agreements; banking and financing litigation including secured/unsecured enforcement and recovery, multi-party creditor disputes, asset recovery and tracing, and disputes regarding various security, financing or trade instruments such as guarantees, bonds and letters of credit; disputes respecting various forms of business organizations such as shareholder agreements, joint ventures, partnerships, distribution, agency and other such agreements; and securities litigation involving insider trading, minority shareholder claims and other such matters.

Civil Litigation involves the body of rights, obligations, and remedies that is applied by courts in civil proceedings to provide relief for persons who have suffered harm from the wrongful acts of others. The person who sustains injury or suffers pecuniary damage as the result of tortious conduct is known as the plaintiff, and the person who is responsible for inflicting the injury and incurs liability for the damage is known as the defendant. The Law Firm of Cohen & Owens, P.A. handles most civil actions, including breaches of contract, defamation, libel, slander of credit, negligence, emotional distress, and invasion of privacy.  Additionally, we handle such economic-related torts as violations of the Florida Deceptive and Unfair Trade Practices Act, the Fair Credit Reporting Act and the Florida Consumer Collection Practices Act.
